6. Plan review – Jergens Piping Corporation

Matt Jorgensen reported he received a permit application earlier in month from Jergens Piping Corporation for a 60×120 storage building towards east side of their property. The building will be used mostly for storing excess materials and trailers. He noted a site plan does not require a public hearing so notice was not put in the newspaper but mailed notice of meeting to property owners within 300ft.

He explained that originally he felt they were not in compliance with lot coverage requirements but realized additional land had been purchased and it was his opinion this would put the building site plan in compliance. He suggested Mostrum be contacted for an additional survey to confirm lot size.

John Friedl – resident to the North of the proposed building commented on prior non-conforming building , screening requirements, land coverage as relates to concrete for parking and grass. He also noted that the company is leaving doors open during sandblasting in their building.

Mr. Brislen asked the Jergens representatives to not continue to leave doors open while sandblasting.

A motion was made by Mike Kinne with support from Rosalyn Miller to approve site plan on condition they get a survey by a licensed surveyor, stake it and note where building needs to be located. The motion carried.

7. Old Business

a. Text Amendments

Matt Jorgensen presented the following recommendations for proposed Zoning Ordinance changes:

1. Ordinance 202.22 Height Measurement:

This comes up often as relates to building height measurements. The other townships give a total building height of 35ft while Park uses a different calculation depending on roof type. He also noted that the lakefront property show the front of the building as the lakefront which can be lower than the street side. He suggested that they consider using the 35ft peak height and that they measure that from the street side rather than the lake side which would make buildings more uniform.

2. Ordinance 202.1 accessory building shall not exceed ground floor area of a principal building.

Mr. Jorgensen recommended striking this ordinance

3. Ordinance 403.3D Remove front yard restriction on accessory buildings in RR, R1, R2 and R3

He noted that these are country lots with very deep houses built back in lot and placement of accessory building would not make a difference.

Mr. Jorgensen presented multiple recommendations for changes to ordinances relating to RR and R3 accessory buildings including lot coverage and maximum size.

4. Ordinance 403.4 Corner Lots:

Suggested changing this that only street with driveway and or address is the front yard and other street frontages are side yard.

5. Ordinance 405.3(b) Nonconforming buildings:

These buildings have language that if destroyed must be rebuilt to original footprint and that it does not exceed assessed value. He noted that currently a new building will not meet that. He suggested that if a building gets destroyed it has to be rebuilt on the same footprint of its own lot, does not extend over property line and that it meets building code requirements and rebuilt without trespassing.

The committee discussed keeping the side yard setback at 15ft due to firefighting issues and allowing second stories or additions that run parallel with an existing nonconformity.

Mr. Jorgensen asked the committee to review these recommendations presented for consideration at a future meeting.

8. New business – Datacenter Text Amendment

Matt Jorgensen presented a packet to members from the attorney with sample ordinance to review at next regular meeting.

It was suggested that the phrase “jet engines” should be changed to gas turbines.

He pointed out that if a specific district/area is set aside for a datacenter it is hard for anyone to fight the township if it meets their needs and not impractical.

9. Public Comments – limit to 3 minutes

None

10. Adjournment

A motion was made by Mike Kinne with support from Rosalyn Miller to adjourn the meeting at 8:32 p.m. The motion carried.
